ED Call Pay – A Better Way
2026/06/02
When hospitals are faced with requests from physicians to be paid for ED call coverage, it is important that they approach the issue in a rational and deliberate manner. If they don’t, chaos can ensue. Merely agreeing to pay doctors from one specialty to keep them happy will lead to several more demanding as good or a better deal. And sitting all the specialists down at the table to “work things out” can result in a Night of the Long Scalpels with different specialties fighting in what they perceive to be a zero-sum game.  Tune in to our special podcast where HortySpringer partners Henry Casale and Dan Mulholland talk to Max Hockenberry from the MaxWorth Consulting Group as they discuss a better way to approach and structure ED call payments using a Call Pay Committee and deferred compensation, which physicians and hospitals who have implemented it have called “The Call Pay Solution.”

Please Tell Me More – Obtaining Meaningful Information from Hospitals and Other Third Parties in the Credentialing Process
2026/03/16
Obtaining information from the hospitals where an applicant has practiced, peer references, and residency or fellowship training programs in which an applicant has participated, is a critical part of the credentialing process as it allows a hospital to confirm an applicant’s current clinical competence and professionalism. But, unfortunately, what sometimes happens when a hospital reaches out to these third parties and requests information about an applicant’s clinical competence and professionalism, they receive very limited information that is not helpful or meaningful, or they get radio silence.   In the latest podcast episode of Crash Course Credentialing, HortySpringer attorneys Lauren Massucci and Moises Tonoc Bonilla explore how to approach the challenges you might face when trying to obtain meaningful information from hospitals and other third parties as part of the credentialing process.

The Brave New World of Ambulatory Peer Review
2026/02/27
Historically, peer review was limited to the review of practitioners’ clinical care for hospital patients.  However, with health care entities providing more clinical services on an outpatient basis and the increase in employed physicians by hospital affiliated entities, there has been significant interest in developing outpatient peer review processes.  But, before moving forward with such a project, there are a number considerations that groups have to evaluate.  For example, the structure that is used for hospital peer review processes usually isn’t required for outpatient peer review.  A more streamlined process is often appropriate and permits groups to make the best of their limited resources.  Also, some state peer review statutes may not extend protections to outpatient peer review.  Therefore, other options for protection need to be considered.  During The Brave New World of Ambulatory Peer Review podcast, Ian Donaldson and Charlie Chulack will touch on these topics and more to assist you in designing your outpatient peer review process.
Compliance Update 2026!
2026/02/12
It’s a new year and there have been several new developments on the fraud and abuse front. The Department of Justice has a new division that will be focusing specifically on fraud. Given the recent activities of the DOJ and the OIG, health care organizations are sure to be in the crosshairs of government scrutiny. Among other things, provider enrollment procedures are likely to tighten up and take longer. And the enforcement agencies and whistleblowers continue to bring False Claims Act cases based on the Stark Law, although the constitutionality of the qui tam provisions of the FCA is being challenged in the Courts.  Join Dan Mulholland and Henry Casale for this informative update in which they will review these developments and suggest some things you can do to minimize compliance risks in the upcoming months.

“Speak No Evil” Can Come at a Cost to Patients
2025/11/05
All too often, a hospital’s response to peer evaluation, especially when there is negative information about the physician, is “name, rank, and serial number.” While this approach may be quick and easy, and feels like it is risk free, it may not be for the patients. The “speak no evil” approach compromises the ability of the hospital on the receiving end of the response from properly credentialing the applicant.  Join us for episode two of Crash Course Credentialing, as HortySpringer attorneys Susan Lapenta and Lauren Massucci explore how you can share your concerns about a problem physician and protect yourself at the same time and most importantly, protect patients.
