31. The Estate Planning Mistakes Divorce Can Expose with Trusts and Estates Attorney, Lauren Klein
2026/10/27
A divorce agreement can divide the assets and still leave major financial risks behind. Trusts and estates attorney Lauren Klein joins Gabriella to explain how wills, trusts, beneficiary designations, life insurance, and account titling can conflict with the terms of a divorce. They discuss why trusts often make asset division harder, how state law affects a spouse’s rights during the divorce process, and how poor coordination can lead to tax problems, probate delays, or lost alimony protection. Lauren also explains why signing a trust is only part of the work and what to ask the professionals handling your estate plan, divorce strategy, and financial accounts.
Lauren A. Klein, Esq., LL.M., is co-founder of Flourish Law Group, a Florida boutique firm focused on estate and tax planning, probate and trust administration, and elder law. She holds an LL.M. in Taxation from the University of Florida, teaches Wills and Trusts at St. Thomas University Benjamin L. Crump College of Law, and hosts the Legal + Wealthy™ podcast.

Three Safeguards That Keep Your Divorce and Estate Plan Aligned:
Review your estate plan as soon as divorce becomes possible. Filing, final judgment, and state law may affect powers of attorney, beneficiary rights, wills, and trusts at different times. Ask a local estate planning attorney what you can change now and what must wait until the divorce is final.
Match the divorce agreement to every controlling document. A judgment may not prevent conflict if a life insurance beneficiary, account designation, or trust provision points elsewhere. Coordinate the decree, estate plan, insurance policy, and beneficiary designations so alimony and asset transfers can happen without a probate fight.
Confirm that your trust is properly funded. A signed trust does not avoid probate unless assets are retitled into it or the trust is named where appropriate. Have your estate attorney and financial advisor review real estate, brokerage accounts, retirement accounts, and beneficiary forms together, AND establish who is responsible for completing each change.

30. Divorce Is Not a Spectator Sport | Why Your Attorney Isn't the Final Decision-Maker
2026/10/13
When you're overwhelmed, the temptation is to hand your divorce over to one trusted advisor and hope they get it right. But outsourcing your decisions, especially to a single expert, is how expensive mistakes happen. In this episode, Gabriella explores why divorce demands active client participation – not passive reliance on a single advisor. She breaks down the attorney's actual role (advocate, not decision-maker), the critical importance of assembling a conflict-free expert team, and why seeking second opinions early can save years of wasted time and money. If you're tempted to outsource your divorce decisions because you're overwhelmed, this episode reframes that overwhelm as a signal that you need better professionals, not fewer.
Resources mentioned:
The E.A.W. Divorce Strategy Framework™
3 Ways to Reclaim Agency in Your Divorce:
Your attorney advocates – you decide. Attorneys are essential, but their role is to inform and advise, not to override your autonomy. You have the right (and responsibility) to ask questions, understand your options, and make decisions that align with your family's needs… even if they differ from your attorney's initial recommendation.
A single expert for all aspects of divorce is a disaster waiting to happen. Complex divorces require legal, financial, emotional, and potentially custody expertise working together. If one advisor tells you to skip another expert entirely, that's a red flag. You deserve full information across all areas before making decisions. Your team should include a conflict-free financial expert (not your pre-divorce joint advisor), a divorce coach or therapist if there's trauma or betrayal, and specialized advisors like business evaluators or CPAs as your case complexity demands.
Overwhelm is a sign to upgrade your team, not surrender your agency. If you feel confused or unheard after working with professionals, you're likely working with the wrong ones. The right experts will clarify complexity and reduce your burden, not compound it. Feeling overwhelmed is your cue to seek second opinions or switch advisors, not to passively accept whatever you're told.

29. Why Successful Men Struggle in Divorce with Men’s Therapist, Marc Azoulay
2026/09/29
Professional success does not guarantee clear judgment when divorce becomes personal. Marc Azoulay, founder of Men’s Therapy Online, joins Gabriella to explain why capable business owners, physicians, and fathers may struggle to make sound decisions when grief, anger, and isolation take over. They discuss why men often lose their usual problem-solving skills during financial negotiations, how emotional pressure can turn a former partner into an “enemy,” and why withdrawing from support can make the damage worse. Marc also shares how group therapy, practical education, and early intervention can help men regain control. The conversation offers a direct warning: how a man handles his emotions during divorce can shape his finances, his future, and his relationship with his children.
Marc Azoulay is the Colorado-based founder of Men’s Therapy Online, where he and his team support men through emotional health challenges, relationship strain, divorce, and major life transitions. He holds a bachelor’s degree in neuroscience from Carnegie Mellon University and a master’s degree in contemplative psychotherapy from Naropa University, hosts the Men’s Therapy Podcast, and is a former president of the Four Corners Group Psychotherapy Society.

3 Ways to Protect Judgment, Finances, and Fatherhood Through Divorce:
Name the emotion before it becomes anger. Grief, fear, betrayal, shame, and powerlessness can all surface as aggression when a man has no language for what is happening. Identifying the actual feeling creates enough distance to respond strategically instead of making a financial, legal, or parenting decision from a threat response.
Build a divorce team before the crisis peaks. Financial analysis, legal advice, emotional support, and co-parenting guidance solve different problems; one professional cannot replace the others. Early support can keep isolation, substance use, workplace trouble, and escalating conflict from compounding the original loss.
Protect the relationship with your children through emotional discipline. Divorce may limit time, money, and control, but a father can still choose how he shows up. Consistent support, restraint, and presence during the next several years can preserve trust that anger and withdrawal may permanently damage.

28. Building Your Divorce Team | Why State Laws (and Legal-Financial Integration) Change Everything
2026/09/15
You can't build a winning divorce strategy alone – and where you live actually determines exactly who you need on your team. Gabriella explains why community property and equitable distribution states create fundamentally different financial outcomes, why the law is constantly changing through court appeals and Supreme Court rulings, and why every financial decision you make is legally scrutinized. Most critically: she breaks down the real risk of working with professionals who don't understand each other's expertise. A financial advisor without legal knowledge, or an attorney without financial acumen, can both steer you wrong. This episode is about building the integrated divorce team that actually protects your wealth.
Resources mentioned:
Ever After Wealth’s Divorce Financial Strategy by State
3 Critical Realities About Divorce Law That Change How You Should Build Your Team:
Your state's legal framework determines your outcome – and "fair" doesn't mean equal. Community property states divide assets 50/50, while equitable distribution states aim for financial equality (which often doesn't mean 50/50), but judges frequently default to equal splits anyway because they lack financial expertise and need a strategist to build a budget they'll actually accept.
Divorce law changes constantly through court appeals and Supreme Court rulings… sometimes within months! Laws on alimony, business goodwill, and marital property are shifting in real-time in every state, making social media advice and outdated information actively dangerous.
Every financial move you make during divorce is legally scrutinized, and one wrong decision can harm your case. A financial advisor who doesn't understand legal implications can guide you into moves that look bad in court, from buying insurance mid-process to spending patterns, but working with professionals who understand both law and finances protects you.

27. How to Divorce Without Destroying Your Family or Finances with Collaborative Attorney Andrea Vacca
2026/09/01
The lawyer you hire can shape the cost, tone, and aftermath of your divorce. In this episode, Gabriella sits down with collaborative divorce attorney Andrea Vacca to examine what changes when you replace the “bulldog” mindset with preparation, financial clarity, and a team focused on solving problems. They separate complexity from conflict, explore how fear can steer expensive decisions, and share what to consider before choosing mediation, collaborative divorce, or litigation. This conversation offers a calmer, smarter starting point for anyone who wants to protect their family, their finances, and the life waiting on the other side.
Andrea Vacca is the founding attorney of Vacca Family Law Group, a New York City firm focused on collaborative divorce, mediation, and other non-adversarial family law solutions. She is trained in positive psychology, the author of Divorce Without Court: A More Peaceful Solution, and the host of A Better Divorce Podcast.

3 Ways to Keep Divorce Clear, Constructive, and Financially Sound:
Choose an attorney for the divorce you want to create. Ask how the attorney approaches negotiation, whether they support mediation or collaborative divorce, and how they help clients preserve workable family relationships. An attorney’s mindset can set the tone before the first negotiation begins.
Build financial clarity before discussing a settlement. Gather complete records of your assets, debts, income, expenses, taxes, and business interests. Then determine how each proposed option could affect your cash flow, lifestyle, and long-term stability. Clear numbers give you room to make deliberate decisions instead of fear-based ones.
Match the divorce process to the dynamics of your relationship. Mediation works best when both spouses can exchange information honestly and advocate for themselves. Financial secrecy, coercion, or a serious power imbalance may require separate attorneys, forensic accounting, or stronger legal protections.

26. Why Your Divorce Can Feel Calm and Still Be Financially Complicated
2026/08/18
Season 2 of Divorce and Money is here, and Gabriella opens it by taking on one of the most common misunderstandings in divorce: the belief that hiring an attorney means every decision is already covered. She explains why even a divorce with no conflict at all can still be financially complicated once you add multiple businesses, real estate, or a mix of account types into the picture, and why that complexity, not conflict, is usually what leaves people frustrated with an outcome they never fully understood. Gabriella also breaks down the difference between a report and a strategy, why attorneys need one and clients need the other, and how she works alongside legal teams without crossing into legal advice. She closes with the advice she gives almost every client (settle custody before you touch the money) and a preview of what's ahead this season, candid conversations built to surface the parts of divorce most people never get told about.

15. The E.A.W. Divorce Strategy Framework™ | Part 2: The Step-By-Step Process That Turns Chaos Into Clarity
In this episode you’ll learn:
Complexity isn't the same thing as conflict. A divorce can be completely amicable and still involve business interests, real estate, or several account types that need real financial expertise to divide fairly. Skipping that step is often what leads to resentment down the road, even when nobody meant any harm.
A report and a strategy aren't the same thing either. Attorneys need the numbers laid out clearly so they can build a legal case, but clients need those same numbers explained in a way that actually makes sense to them. That translation, not just the math, is the real work.
If custody is still unresolved, settle it before the financial negotiations start. Left open, it can quietly turn into leverage, and that almost never ends well for anyone.

25. Are You Paying the “Confusion Tax” in Your Divorce?
2026/06/02
Divorce can make even the smartest, most successful person feel rushed, pressured, and unsure of their next financial move. In this season finale, Gabriella Martinelli names the hidden cost that shows up when people make complex divorce decisions under stress: the confusion tax. She explains why meaningful assets require divorce-specific financial strategy, how retirement accounts, business ownership, medical practices, executive compensation, support numbers, valuations, and settlement language can quietly change the outcome, and where listeners should begin in the podcast catalog during the summer break. This episode is the conversation Gabriella would have across the table in a first call: direct, clarifying, and focused on helping you protect your wealth, your choices, and the life you are building next.

Divorce decisions made under stress, pressure, or incomplete information can create financial consequences that last long after the divorce is final.
A settlement that looks equal on paper can be unequal in real life because taxes, liquidity, withdrawal rules, account type, and timing all affect the actual value of an asset.
Business ownership, medical practices, executive compensation, stock options, retirement accounts, and valuation issues require divorce-specific financial strategy, especially when settlement language has to hold up with courts, attorneys, and financial institutions.

24. Betrayal Trauma & Divorce Decisions with Post Betrayal Syndrome Expert, Dr. Debi Silber
2026/04/21
If you’ve been through it, you know that betrayal doesn’t just break trust – it disrupts how you think, feel, and make decisions. And in divorce, that can have serious financial consequences. In this episode, Gabriella sits down with Dr. Debi Silber, founder of the Post Betrayal Transformation Institute, to explore how betrayal trauma impacts both the mind and body, and why traditional approaches to healing often fall short. They break down the five stages of betrayal recovery, the concept of Post Betrayal Syndrome, and why so many individuals get stuck in a place that feels “fine” but isn’t truly healed. Most importantly, this conversation connects emotional recovery directly to financial decision-making, helping you understand why clarity is so difficult, and how to move toward it.
Dr. Debi Silber, Ph.D. is the founder of the Post Betrayal Transformation Institute and a globally recognized expert in betrayal trauma and Post Betrayal Syndrome. She is a two-time number one international bestselling author who has studied the impact of betrayal across more than 100,000 cases, helping individuals and professionals understand and heal from its effects.

Betrayal trauma impacts far more than emotions… it disrupts your ability to trust yourself, think clearly, and make sound decisions. This is why many people struggle to engage effectively in financial and legal conversations during divorce.
Most people get stuck in “stage three,” where they appear functional but are still operating from pain, fear, and distrust. Decisions made in this stage often lead to costly mistakes, emotionally and financially.
Healing from betrayal follows a predictable path, and the goal is to reach a place where decisions are made from clarity and strength – not survival. The more you invest in that recovery, the better your long-term outcomes will be.

23. The Hidden Option: ESOPs & How to Save Your Business During Divorce with Matt Middendorp
2026/04/07
Divorce can put everything a business owner has built at risk – financially, emotionally, and operationally. In this episode, Gabriella is joined by Matt Middendorp to unpack one of the most overlooked strategies for protecting a business during divorce: Employee Stock Ownership Plans (ESOPs). Together, they explore how business owners can meet large divorce settlement obligations without selling their company, losing control, or sacrificing their legacy. This conversation reframes divorce from a forced liquidation event into a strategic transition, one that can preserve both the business and the people behind it.
Matt Middendorp is a business valuation expert with 20+ years of experience providing valuations for litigation support, divorce, probate, estate and gift tax, and M&A. He leads litigation support work at Vision Point Capital, a boutique firm that supports specialty valuation work, ESOPs, and M&A “cradle to grave.”

21. Business Valuation in Divorce | What Business Owners Need to Know (and What Can Go Wrong) with Matt Springer
In this episode you’ll learn…
An ESOP allows you to sell part, or even all, of your company to an employee-owned trust while still maintaining control. This creates a path to meet financial obligations without sacrificing your role or the legacy you’ve built.
ESOPs can create significant tax advantages and improved cash flow, especially for S-corporations. Because the savings scale with how much of the company is sold, they can make large divorce settlement payments more manageable.
Starting early with education and a feasibility study gives you clear financial insight before mediation. This preparation helps you make informed decisions with greater confidence and less emotional pressure.

22. How Financial Clarity Saved Their Settlements | The Psychology of Divorce Decisions, Pt. 3
2026/03/24
In this final episode of the Psychology of Divorce Decisions series, Gabriella brings both sides of divorce dynamics together: the spouse paralyzed by fear and the spouse facing unrealistic demands, and shows what happens when financial clarity replaces emotion and assumption. Through real client stories, she reveals how accurate business valuations, documented financial analysis, and sustainable cash flow projections can transform divorce negotiations, prevent costly settlement mistakes, and protect long-term stability. From uncovering over $1 million in undervalued assets to challenging fantasy support numbers built on unrealistic income assumptions, this episode makes one thing clear: financial clarity doesn’t guarantee a perfect outcome, but operating without it almost always guarantees a damaging one.
Resources mentioned:
When Trusting the Wrong Person Feels Safer Than Protecting Yourself - Gabriella’s blog on the neuroscience behind financial fear and trauma bonding in divorce
Some key takeaways from this episode:
Financial clarity replaces fear-based decisions. Divorce creates emotional and decision fatigue that clouds judgment, but when you understand your real numbers (assets, liabilities, income, and costs), you move from panic and paralysis to informed, confident choices.
The same clarity protects both sides. For the financially uninformed spouse, clarity reveals what actually exists. For the high earner facing unrealistic demands, it provides defensible data that shifts negotiations from emotional conflict to sustainable solutions.
Sustainable settlements require understanding, not assumptions. Knowing what assets are truly worth, what support is realistically payable, and what it takes to preserve a business prevents agreements that collapse within years and protects both parties’ long-term stability.

21. Business Valuation in Divorce | What Business Owners Need to Know (and What Can Go Wrong) with Matt Springer
2026/03/10
When a business is at stake in divorce, the valuation becomes one of the biggest financial and emotional pressure points. In this episode, Gabriela sits down with business valuation expert Matt Springer at VisionPoint Capital, to break down what makes a credible business valuation, how commingled personal and business expenses can derail settlements, and why state laws on personal goodwill create vastly different outcomes. They explore the three valuation approaches (income, asset, and market), the role of direct owner interviews, and how expert collaboration, rather than adversarial positioning, can significantly reduce legal costs and conflict.
Matt Springer is a business valuation expert with 20+ years of experience providing valuations for litigation support, divorce, probate, estate and gift tax, and M&A. As Director of Valuation & Litigation Support at VisionPoint Capital, a boutique firm specializing in valuation advisory, ESOPs, and M&A services, he works with clients nationwide on complex business valuations and transaction needs.

3 Ways to Protect Your Business Value During Divorce:
A defensible business valuation doesn’t rely on a single formula. It evaluates the business using the income, asset, and market approaches, then reconciles those methods into a supported conclusion. Working with a credentialed valuation professional who follows recognized standards, like USPAP, helps ensure the result is credible and able to withstand legal scrutiny.
Financial statements rarely tell the full story. A valuator needs direct access to the business owner to understand operational realities, unusual expenses, and whether personal and business finances have been commingled. Without those conversations, assumptions replace facts, and assumptions increase risk.
Clear documentation protects credibility. Engagement letters should define scope, valuation standards, and how complex issues like personal goodwill will be handled. Consistent methodology and full transparency around assumptions are essential if the valuation is later challenged in mediation, deposition, or court.

20. Facing Demands That Don’t Make Sense | The Psychology of Divorce Decisions, Pt. 2
2026/02/24
What happens when you’re doing everything “right”... and it’s still not enough? In this second episode of the series, Gabriella explores what it feels like to be the spouse carrying the financial weight of divorce while facing demands that feel impossible, emotionally charged, or completely detached from reality. She breaks down how fear, guilt, and social pressure twist negotiations, and why even fair offers can be rejected when pain is driving the process. With real client stories and insights for high earners, this conversation reframes clarity not as control, but as a path to peace.
Resources mentioned:
When Trusting the Wrong Person Feels Safer Than Protecting Yourself - Gabriella’s blog on the neuroscience behind financial fear and trauma bonding in divorce
Some key takeaways from this episode::
Social pressure skews what feels “fair.” Friends, family, and social media often feed unrealistic expectations, and those distortions derail real financial conversations.
Breadwinners carry more than numbers. High earners often feel judged on their morality, not just money, which can push them into unsustainable agreements just to feel like they did the “right” thing.
Clarity isn’t about control, it’s about peace. A neutral expert can shift emotional chaos into fact-based solutions that serve both sides long-term.

19. Litigation vs. Mediation vs. Collaborative Law | Choosing the Right Divorce Process with Mediator, Susan Guthrie
2026/02/10
Most people think divorce starts by hiring an attorney. But in this episode, Gabriella and seasoned mediator Susan Guthrie break down why how you begin the process can shape your financial future more than anything else. They explore the real differences between litigation, collaborative divorce, and mediation, not in theory, but in practice, especially for high-net-worth couples. From the hidden risks of courtroom battles to the emotional pressure points of collaborative law, this episode offers clarity for anyone facing major decisions about when and how to begin. Gabriella and Susan also unpack the financial blind spots professionals often overlook, and what kind of support actually helps spouses make clear, lasting decisions.

In this episode you’ll learn…
Mediation prioritizes your future, not your fight. Unlike litigation and even collaborative law, mediation empowers couples to stay in control and co-create outcomes; especially helpful in complex financial divorces.
Your best first step is education, not litigation. The biggest mistakes happen when people hire attorneys in the heat of fear or anger. Slow down, get educated, and talk to three mediators or collaborative attorneys before deciding.
Support levels the playing field. Financial educators and divorce coaches can ensure less financially experienced spouses aren’t left behind -- leading to smarter, more lasting agreements for everyone involved.

18. How Financial Fear Hijacks Divorce | The Psychology of Divorce Decisions, Pt. 1
2026/01/27
Why do smart, successful women stay quiet when money is on the line? In this first episode of a three-part series, Gabriella dives into the psychology of divorce decisions -- specifically, how financial fear takes over when clarity is needed most. She unpacks how trauma bonding disrupts your survival instincts, how financial abuse hides in plain sight, and why getting informed isn’t just smart, it’s life-changing. With real client stories and real neuroscience, Gabriella shows why this isn’t about weakness, it’s about wiring, and how knowledge can bring you back to power.
Resources mentioned:
When Trusting the Wrong Person Feels Safer Than Protecting Yourself - Gabriella’s blog on the neuroscience behind financial fear and trauma bonding in divorce
Some key takeaways from this episode:
Trauma bonding isn’t weakness -- it’s survival. Financial fear often comes from real emotional wiring, not a lack of intelligence or strength. Understanding the neuroscience helps reclaim control.
Clarity doesn’t threaten your marriage; it protects your future. Getting informed isn’t a declaration of divorce, it’s how you protect your rights and prepare for any outcome.
Financial abuse hides in plain sight. It often looks like love, protection, or “just how things are.” Recognizing the signs is the first step toward change.

Men aren’t broken, they’re unresourced. Most men are taught to suppress emotion and “handle it,” which backfires in divorce. Emotional skill-building is essential.
Support isn’t weakness, it’s protection. Whether it’s a coach, a men’s group, or a financial expert, having the right team helps men protect their kids, wealth, and wellbeing.
You can’t make smart decisions from survival mode. Strategic divorce planning starts with regulating your nervous system, and that’s not something you do alone.
Marriage is about love, but divorce is about money. The Divorce & Money Podcast, hosted by Gabriella E. Martinelli, CDFA®, CDS®, is all about how to navigate your separation and divorce so you can set yourself up for a strong financial future. Gabriella is the Founder at Ever After Wealth®, a divorce financial strategy firm.
