In Newsom v. Trump, a split Ninth Circuit panel affirmed Judge Charles Breyer's preliminary injunction, with Judge Jennifer Sung writing for the majority and Judge Eric Miller concurring. But Judge Mark Bennett dissented, and his dissent is the real story. Bennett argues the majority should never have decided this appeal at all. He says the majority invented a "constitutional ultra vires claim" to sidestep the Supreme Court's strict limits on such suits. In his words, the plaintiffs' "Hail Mary pass scores." And he says California's Tenth Amendment theory fails because the Constitution expressly gives Congress the power to call forth the militia. Yesterday the full Fifth Circuit, sitting en banc, ruled that the alien had a right under habeas corpus to the procedural step of having a court consider the question, but no substantive legal right to bond and release if Congress had ruled otherwise—and in the case of aliens unlawfully in the United States, Congress HAD ruled otherwise. In Rodriguez v. Vergara, Judge Cory Wilson wrote for the majority, reversing two Western District of Texas judges who had ordered detained aliens released. Those two trial judges, and a divided three-judge panel, found a Fifth Amendment right to a bond hearing, and the panel even invented a 90-day deadline. The en banc majority vacated all of it, holding that while aliens are entitled to the right of habeas corpus, habeas is a procedural matter limited to having the question of release answered by a court, it is not a guarantee of liberty within our borders. The substantive question of release on bond is a separate statutory matter. Seven judges dissented. So is the majority correct that the Constitution guarantees the PROCEDURE of habeas, but leaves the SUBSTANCE of release on bond to Congress, not the courts? A federal appeals court just called a sitting federal judge's work "a botch job, to say the least." That judge is Henry Wingate of the Southern District of Mississippi, and the case is Jackson Federation of Teachers v. Fitch, the challenge to Mississippi's anti-DEI law, House Bill 1193. Wingate blocked the law with an order citing parties, declarations, and quotations that simply did not exist. When that came to light, he replaced the order without explanation, and even the "corrected" version cited a case that does not exist. Now a Fifth Circuit panel, in an opinion by Judge Jerry Smith, has vacated his injunction and taken the case away from him entirely. Kohen Wiley was killed by police at only 1-years-old, and the newly released body-cam and surveillance videos show exactly how it happened. On June 14, Senatobia, Mississippi police chased two women accused of shoplifting diapers and baby clothes from Walmart into the parking lot. One of them, Vellesiya Wiley, was carrying her son Kohen as she ran for the car. A federal judge says the government lost all its credibility. Now she wants answers under oath.  This morning, Judge Ana Reyes called senior Trump officials into her DC courtroom.
