Doch wie kann sichergestellt werden, dass die Gegenseite nicht nur bezahlen will, sondern auch kann? Was tun, wenn der Beklagte im Schiedsverfahren einfach nicht erscheint? Welche Möglichkeiten hat das Schiedsgericht, gegen den Säumigen vorzugehen? Eine der meist diskutierten Fragen in der Schiedsgerichtsbarkeit ist die nach dem anwendbaren Recht auf die Schiedsvereinbarung, wenn die Parteien das anwendbare Recht nicht ausdrücklich gewählt haben. Bisher folgen die meisten Länder noch dem Recht des Sitzes des Schiedsgerichts. Aber wird das so bleiben?
