California's Prior Authorization Remodel: SB 306 and the New Role of DHCS
2026/09/30
California's Senate Bill 306 reshapes the prior authorization landscape by codifying Health and Safety Code Section 1367.025 and granting the Department of Health Care Services broad authority to determine when insurers may require prior authorization for covered health care services. Beginning in 2026, DHCS must collect data on insurer approval and denial rates, and no later than January 1, 2028, direct insurers to remove prior authorization requirements on services approved at a rate of 90% or greater, subject to carve-outs for experimental, investigational, and out-of-network services. This program also situates the reform within the broader national debate over prior authorization and explores how the shift in regulatory power may reshape health insurance litigation. Attendees will leave equipped to advise clients on compliance obligations, exemption determinations, and emerging litigation risks under Section 1367.025.

Anthony Zaller of Zaller Law Group breaks down the wage and hour fundamentals that drive the most litigation, including meal and rest break compliance, overtime classification, and recordkeeping obligations. He then turns to building defensible terminations through documentation, performance management, and proper final pay practices, as well as the reasonable accommodation standards and interactive process requirements that frequently surface in disability claims. The Human Baseline: AI Displacement and the Silent Recalibration of Legal Doctrine

Jim Ko, Founder of the AI Rights Project, terms this silent recalibration and presents the Human Baseline framework as the interpretive discipline required to address it. The framework surfaces across three doctrinal areas:
Copyright: Machine-scale ingestion of billions of works is treated as equivalent to human reading, without examining whether the Human Creativity predicate survives.
Institutional free speech: Platforms claim First Amendment editorial discretion for algorithmic curation while simultaneously disclaiming accountability for the content that curation produces.
Title VII: AI hiring systems displace Observational Capacity and Attributable Agency simultaneously, generating operative criteria no human specified and no human can validate.
Attendees leave with an interpretive tool that identifies when predicate displacement has occurred, forces courts and clients to confront who has authority to recalibrate it, and insists on congressional or constitutional authorization before doctrine bends to the technology, a discipline applicable across any practice area where AI has entered the picture.

The Coast in Contest: Federal Pressure, State Power, and the Shifting Map of Coastal Regulation

California's coastal zone is among the most heavily regulated land in the nation, and the rules governing it are in unusual flux. The California Supreme Court's unanimous April 2026 decision in Shear Development Co., LLC v. California Coastal Commission reined in the Coastal Commission's appellate jurisdiction over local coastal development permits, holding that courts apply independent judgment to questions of local coastal program interpretation and owe no deference to the agency when its reading and the county's are equally plausible. Douglas Carstens of Carstens, Black & Minteer uses that decision as a springboard into the larger landscape: how the Coastal Act and local coastal programs allocate authority, where the current wave of deregulatory pressure is coming from, and what it means when the federal government, through a Commerce Department review of California's coastal management program under the Coastal Zone Management Act, signals interest in loosening the state's hold over offshore energy, development, and infrastructure. The session steps back from any single case to examine coastal zone regulation as a whole and the practical consequences for practitioners advising developers, local governments, and environmental clients in a moment when the regulatory map is being redrawn.
