Tennessee Fails to Execute Christa Pike for Colleen Slemmer's Murder, Two Doses and She Survived, Governor Halts All 2026 Executions

After the Sixth Circuit stayed her execution an hour before its scheduled 10 a.m. start and the U.S. Supreme Court vacated that stay hours later, the state administered two doses of pentobarbital — the maximum its protocol allows — and Pike, 50, remained alive. Media witnesses reported she was still breathing more than 40 minutes later. She was taken by ambulance to a hospital, and her attorneys say they still have not been told her condition. Gov. Bill Lee has paused the state's remaining 2026 executions and called for a comprehensive third-party review. Pike was sentenced to death in 1996 for the 1995 torture killing of 19-year-old Colleen Slemmer in Knoxville; she was 18 at the time, and her lawyers had warned a blood disorder created a substantial risk of a prolonged and painful execution. Prosecutors argued Flynn shot his wife as she slept and staged the scene as a burglary, pointing to a garage door damaged only from the inside, his own missing handgun, phone activity during the hours he told police he was asleep, and more than 100,000 messages with a worship leader at his church, who has not been charged. Flynn, who quietly wept as Judge Jeannine Pratt read the verdict, faces up to life without parole; sentencing is scheduled for next week. GUILTY: Surgeon Tomasz Kosowski Convicted in Steven Cozzi Murder, Won't Fight for His Own Life, Caleb Flynn's Mistress Reads the Texts

Plastic surgeon Tomasz Kosowski, 47, was convicted of first-degree murder last Wednesday in the 2023 killing of Largo attorney Steven Cozzi, 41, after representing himself, waiving his right to a jury, and putting on no defense. Judge Joseph Bulone deliberated about 15 minutes. Kosowski then declined counsel for the penalty phase and said he will present no mitigating evidence; a Spencer hearing is set for Oct. 8, after which Bulone alone will decide between life without parole and death. In Ohio, Alleigha Botner, 24, testified for two days in the trial of Caleb Flynn, 40, the former American Idol contestant charged in the February shooting death of his wife, Ashley Flynn, 37 — reading aloud from roughly 107,000 messages and telling jurors she now hates him because she believes he killed his wife. Flynn has pleaded not guilty; Botner has not been charged. Mary Kellerman was twelve years old when her parents gave her an Extra-Strength Tylenol capsule on the morning of September 29, 1982. She died that morning. Within three days, six more people in the Chicago area were dead: Adam, Stanley and Theresa Janus, Mary McFarland, Paula Prince and Mary Reiner. Seven people, poisoned by potassium cyanide packed into capsules on a drugstore shelf, and no one has ever been charged. The foil seal on every bottle in every American medicine cabinet exists because of them. Forty-four years later, a sheriff's office in Idaho has identified the "Unknown Wanderer," a man who died by cyanide poisoning under a church pew in Boise two months after the killings, and laid out circumstances it says warrant scrutiny — while stating plainly it is not naming him a suspect and cannot place him in Chicago that week. Illinois investigators who worked the original case say the cyanide was a different compound, the DNA did not match, and the task force ruled him out decades ago. In Massachusetts, lawyers for Lindsay Clancy — charged in the deaths of her children Cora, 5, Dawson, 3, and Callan, 8 months, and never convicted or acquitted after this month's mistrial — moved to dismiss on double jeopardy grounds and asked Judge William Sullivan to examine the holdout juror's phone records. Matthew Exton Sentenced to Up to 24½ Years, a New Trial Denied for Gerhardt Konig, and Tomasz Kosowski Starts Cross-Examining

Matthew Exton, 43, a former attorney convicted of attempting to shoot his ex-wife at the opening night of Sabira restaurant in Toledo, was sentenced Monday by Lucas County Judge Gary Cook. Exton tried to fire his attorney the morning of the hearing, then told the court that pointing a loaded gun at his ex-wife was not harm because it did not fire. Cook played the surveillance video, saying it showed Exton trying to disengage the safety after the gun failed — the moment that "cements the intent." Exton says he will appeal. Also: Judge Paul Wong denied Dr. Gerhardt Konig's motion for a new trial after questioning all twelve jurors, finding no outside influence despite reporting that an anonymous livestream commenter who claimed contact with a juror correctly predicted the verdict. The holdout juror in Lindsay Clancy's murder trial has been publicly identified, had his address and phone number posted online, received death threats, and is now in an undisclosed location in rural northern New England with counsel. In a statement to NewsNation, Michael P. Desronvil disputed his fellow jurors' accounts: "I didn't have any doubts," and said he believed from the evidence that Clancy "knew exactly what she was doing and planned" it — a direct contradiction of foreperson Roni Carlson, who told NBC10 Boston he had admitted reasonable doubt and whose note prompted the defense to seek his removal. Judge William Sullivan refused, and no court has found Desronvil did anything improper. A GiveSendGo campaign for his security and legal costs has passed $330,000. Kevin Reddington has filed a renewed motion asking Sullivan to enter a required finding of not guilty, arguing the Commonwealth's evidence was insufficient; the status hearing is September 29. Elizabeth Holmes Has a Secret A24 Documentary, a Revived Account, and a Clemency Petition Sitting at the Justice Department

A secret documentary about Elizabeth Holmes premiered at Telluride on September 6. "You Can See Everything", directed by Nathan Fielder and Lance Oppenheim, distributed by A24, filmed over three years beginning 34 days before she reported to federal prison. It screens at the New York Film Festival on September 30 and opens theatrically in October. Meanwhile, Holmes's X account, revived in August 2025 after a decade of silence and reportedly run by her partner Billy Evans, has been posting frequently and protesting her innocence. And a clemency petition asking the President to commute her sentence remains listed as pending with the Justice Department's Office of the Pardon Attorney. A full account of the case: Holmes was convicted in January 2022 on one count of conspiracy to defraud investors and three counts of wire fraud, acquitted on all patient-related counts, and sentenced to 135 months plus $452 million in restitution. Ramesh Balwani, tried separately on an identical indictment, was convicted on all twelve counts and is serving longer. The Ninth Circuit affirmed everything in February 2025. Michael Proctor Takes the Fifth and Every Case He Worked Inherits a Question, No Death Penalty for Nick Reiner, a Wagon in Largo

Former Massachusetts State Police trooper Michael Proctor invoked his Fifth Amendment right rather than answer questions at a hearing in a Milton murder case he led — the 2021 killing of 25-year-old Marquis Simmons. Judge Peter Krupp allowed it after a sidebar his defense counsel was barred from joining. Defense attorney Rosemary Scapicchio, who is seeking dismissal of charges against Myles Omari King, 26, said Proctor's lawyer had twice indicated he would testify. Proctor was dishonorably discharged over messages found on his phone during the Karen Read prosecution; he has not been charged with any crime, and invoking the Fifth is not evidence of wrongdoing. Kosowski has pleaded not guilty and is presumed innocent; he has dismissed four sets of attorneys, waived a jury for both phases, and withdrawn his prior counsel's suppression motions and death-penalty challenges. Judge London Kite has refused to step aside from Shanna Gardner's murder case after both prosecutors and Kirsten Bridegan — the widow of victim Jared Bridegan — filed motions asking her to disqualify herself. Kite ruled both legally insufficient without addressing the factual allegations. The dispute began when Gardner's defense sought Kirsten Bridegan's cellphone; Kite initially denied the request, then ordered her to surrender it after an ex parte meeting with Gardner's attorneys that neither prosecutors nor Bridegan's lawyers attended. When she refused, Kite initiated indirect criminal contempt proceedings during Mario Fernandez Saldana's trial. The Fifth District Court of Appeal has stayed the order. Prosecutors wrote that Kite's conduct "created the appearance that matters involving Kirsten Bridegan, a material prosecution witness and constitutional crime victim, had been prejudged." Kosowski has dismissed multiple defense teams, is representing himself, withdrew his prior counsel's motions to suppress evidence and their challenges to the death penalty, and waived a jury for both the guilt and penalty phases — a dual waiver attorneys describe as exceptionally rare. Asked by Judge Joseph Bulone why he didn't want a jury, he replied, "I really have to answer that?" He has pleaded not guilty and is presumed innocent; prosecutors are seeking death.
