NY EXECUTIVE LAW 63 - SECTION 12 HAS BEEN ON THE BOOKS FOR 70 YEARS AND IS RESPONSIBLE FOR HOLDING BUSINESSES ACCOUNTABLE FOR HUNDREDS OF MILLIONS OF DOLLARS. THE FINANCIAL PENALTY IS STAGGERING, BUT THE APPOINTMENT OF AN INDEPENDENT MONITOR, AN INDEPENDENT DIRECTOR OF COMPLIANCE, AND THE INABILITY TO CONDUCT BUSINESS FOR A FEW YEARS IS BRUTAL PUNISHMENT FOR A MAN WHO HAS ALWAYS BEEN BOSS.

What should have been a celebration for President Biden turned into a ”Media Feeding Frenzy” about his Age and Memory following a personal, poorly written report by a Republican Special Counsel. The Good News is that Biden was cleared of wrongdoing for retaining classified documents. Trump continues to act like a wanna-be Dictator. In a sweeping, legal rebuke, the United States Court of Appeals for the District of Columbia Circuit denied Donald Trump’s appeal for Immunity from Criminal Prosecution. At least temporarily.  “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” the panel wrote. “But any executive immunity that may have protected him while he served as president no longer protects him against this prosecution.” Trump’s claim that he was immune from prosecution on charges of plotting to subvert the results of the 2020 election, means he must go to trial on a criminal indictment accusing him of seeking to overturn his loss to President Biden. While this is a significant defeat, Trump is sure to Appeal to the Supreme Court.

Three of the four Trials former President Donald Trump faces this year made news last week.  The Federal Election Interference Case in Washington, D.C. was delayed. Court officials are waiting for a decision from the D.C. Court of Appeals on Trump’s claim that he can’t be prosecuted because of Presidential Immunity. Because this was delayed, the ”Pay-offs to a Porn Star” Case in New York could be back on Track. The Documents Case in Florida had a significant filing by Special Prosecutor Jack Smith, who also met with the Judge. And, of course, the Georgia Election Interference Case had a deadline of last Friday. Feb. 2 on a Motion to Dismiss from three of the defendants.      That Motion accused Fulton County District Attorney Fani Willis of being involved in an ”inappropriate relationship” with one of the Special Prosecutors she hired to assist her in the case.  You can watch a YouTube video I’m producing for more on this story. I have an update on the latest political news, and as promised, I will share some of the article by Dana Milbank for The Washington Post, ”The last remnants of the Republican Party died in Iowa.” https://www.washingtonpost.com/opinions/2024/01/15/2024-iowa-caucuses-gop-candidates-trump/ In one section, Milbank describes some of Trump’s only speech in Iowa. It begins with a Campaign Video that proclaims that Trump is ”God’s” Candidate and that he was created to fix our country. Here is an excerpt from the article. “We’ve got a crooked country,” run by “stupid people,” “corrupt,” “incompetent,” “the worst.” Trump, in the gospel according to Trump, was the victim of “hoaxes,” “witch hunts,” “lies,” “fake indictments,” “fake trials,” judges who “are animals,” a “rigged election,” “rigged indictments,” and a “rigged Department of Justice where we have radical left, bad people, lunatics. The nation’s capital, Washington, D.C., “is a rat-infested, graffiti-infested shithole,” he said, with swastikas all over the national monuments. His opponents, the prophet Trump continued, are “Marxists,” “communists,” “fascists,” “liars, cheaters, thugs, perverts, frauds, crooks, freaks, creeps,” “warmongers” and “globalists.” Immigrants are like a “vicious snake,” whose “bite is poisonous,” he told them, and there is an “invasion” at the border by “terrorists,” “jailbirds,” and “drug lords.” “Our country is dying,” he informed them. And, by the way, “You’re very close to World War III.” Have a nice day!” End quote Since Milbank wrote the article, DeSantis has dropped out, and even though Nikki Haley may be a bump up from this, more and more Republicans are publicly supporting the MAGA Candidate, Donald Trump. One of Trump’s co-defendants in the massive Georgia Racketeering Case accuses Fulton County District Attorney Fani Willis of engaging in an ”Inappropriate” relationship with Special Prosecutor Nathan Wade, whom Willis hired. The co-defendant, Mike Roman, wants the charges against him dismissed. Judge Scott McAfee has scheduled a February 15 hearing on that Motion for Dismissal. That Motion to dismiss offered ”No Proof” of wrongdoing. Trump quickly seized on the allegations and sent out a fundraising e-mail. And while Willis has not yet responded directly to the allegations, she did talk about the burdens of the case and the constant threats to her life and the lives of her family members. For the second time in the last nine months, Writer E. Jean Carroll Testified before a jury about being sexually assaulted by Donald Trump. But this time, she was telling her story in front of the former President, who has been found liable for attacking, harassing, and defaming her. The Jury will determine how much money to award E. Jean because Trump has already been found guilty.  There was another twist to this Hearing: Trump, loudly and with flourishes of hostile ”body language, made it clear how unhappy he was with the trial and the testimony.  The Judge, Lewis Kaplan, made it clear that Trump needed to quiet down, or he would be thrown out of the courtroom. AN ”ANONYMOUS” JURY FOR E. JEAN CARROLL v. TRUMP and WHY I LOVE IOWA. The judge in the E. Jean Carroll Case is taking extra security precautions to protect jurors from possible harassment from Trump ”Trolls.”  We still don’t have a Budget, and we will miss another deadline.  And I explain why I love Iowa.

Ironically, the Iowa Caucuses are falling on the Day we all need to remember Dr. Martin Luther King, Jr., A man who fought and died for racial equality and voting rights for all.   All the media attention on Iowa is focused on Republicans. White Republicans. Donald Trump fans.  President Biden changed how the Democratic Party holds its Primary and the Iowa Caucus.  Why? He thought it would be better for the Country to focus on states representing a diverse group of Americans instead of predominately White Iowa.  Biden is campaigning in South Carolina. Black voters in South Carolina helped him win the Presidency in 2020.  Like it or not, Iowa is a predominately white, Christian, fundamentalist State.  Iowa is 84.5 percent White. THE TRUMP TRIALS 2024 - Donald Trump is gearing up for a year of multi-tasking in 2024. He is running for President, and he is running away from 91 Felony Counts in various State and Federal Courts. In addition to the Criminal Charges, Trump is fighting to keep control of his business empire in the State of New York, and trying to defend himself in the E. Jean Carroll Defamation Case - Part Two. There are some key dates in this month alone, including a DC Appeals Court hearing on his Election Interference Case, where he claims he has immunity and has asked that the charges be dismissed. And hanging over all this is whether the United States Supreme Court is going to step in and rule on the 14th Amendment, Section Three. The States of Colorado and Maine want Trump’s name off their Primary Ballots. Whew! And this is just a short overview. I’ll have more in the days to come.
